Business Innovation Visa 188A:

Benefits of the Business visa – 188A:

  • operate a new or existing business in Australia
  • stay in Australia for up to 5 years
  • bring eligible members of your family with you
  • apply for a permanent Business visa later

Eligibility requirements for visa 188A:

1- Be nominated

You must be nominated by an Australian State or Territory government agency, before being invited to apply for this visa.

2- Have business ownership

For 2 out of 4 fiscal years immediately before you receive an invitation to apply, you must have had an ownership stake in 1 or 2 businesses that had at least:

  • AUD750,000 turnover in each of those 2 years

      Whether you have 1 or 2 businesses, you must own at least:

  • 51%, of the total value of the business if the business has a turnover of less than AUD400,000 per year
  • 30%, of the total value of the business if the business has a turnover of AUD400,000 or more per year, or

If your business provides professional, technical or trade services, you must have spent less than half your time providing those services, rather than general management of the business.

3- Own personal and business assets

When you are invited to apply for this visa, you, your partner, or you and your partner combined must have total net business and personal assets of at least:

  • AUD1.25 million.

Your funds must be available to transfer to Australia within 2 years of us granting the visa.

4- Score at least 65 on the points test

You must score at least 65 points on the points test.

You can get points for many reasons, including your: 

  • age
  • English language ability
  • qualifications
  • business experience
  • net personal and business assets
  • business turnover
  • innovation
  • special endorsement

5- Have a successful business career

You must have a successful business career and a genuine desire to continuously own and manage a business in Australia.

6- Be under 55

You will not receive an invitation if you are aged 55 or older at the time of the invitation to apply for the visa.  If you are older, a State or Territory might invite you to apply for this visa if your business will be of exceptional economic benefit.

Not have a history of involvement in unacceptable activities

You and your partner must have had no history of involvement in business or investment activities that are of a nature that is not generally acceptable in Australia.

7- Have functional English

All applicants aged 18 or over at the time of application must either have at least an IELTS (academic or general) band score of 4.5 in the last 12 months or you will be asked to pay the second installment of the visa application charge. 

8- Meet the health requirement

You and any family members who apply for the visa with you must meet our health requirement.

Family members who are not coming to Australia might also meet the health requirements.

9- Meet the character requirement

You and family members aged 16 years and over who apply for the visa with you must meet our character requirement

Family members who are not coming to Australia must also have to meet our meet the character requirement. 

 

Different Australian states' nomination criteria for Business visa 188A:

New South Wales nomination:

  • You must be under 50 years old
  • You must have a bachelor’s degree or equivalent. Or
  • In the last 10 years, you have at least 3 years of business experience in the field of advanced products/food production/food technology/cyber security/airspace. or
  • Have at least 5 years of business experience in a sector other than the above.
  • Your total personal and business net worth should be at least:

         – AUD 1,750,000 – to invest in Sydney or

         – AUD 1,250,000 – invested in sparsely populated areas of NSW.

  • The annual turnover of your business should be at least equal to:

          – AUD $1,250,000 – to invest in Sydney or

          – AUD $750,000 – invested in sparsely populated areas of NSW.

  • You must score at least 65 points.
  • You must provide a business plan.
  • To obtain an invitation for permanent visa 888, you must have made a business investment with the following specifications when you have a 188 visa:

                        – AUD 500,000  – Sydney

                        – AUD 300,000 – Regional NSW

Victoria nomination:

  • Innovation capability:

You must demonstrate your capacity to establish a business by demonstrating one of the following:

  • Your principal overseas business has a minimum annual turnover of AUD 1,750,000, or
  • You have a bachelor’s degree in business, basic science or engineering from an accredited university, or
  • You have a business that has exclusive rights or trademarks.
  • Age:

           You must be under 55 years old at the time of visa application.

  • Business history:

            You have at least 3 years of business ownership experience.

             We may request a summary of your current business  

  • Be committed to establishing, operating, and growing a Victorian business,
  • Be committed to meeting the requirements for permanent residence
  • You may be required to provide supporting documents in your application to show that you have relevant business experience in a field highly related to your proposed Victorian business.We

South Australia nomination:

  • • You must intend to live in South Australia.
    • Score at least 80 points in the Department of Home Affairs points test.
    • Proposing an investment or business activity in SA that meets the SA State’s nomination of the “benefits to the State requirement” for subclass 888.
    • If you are over 55, you must show that the offer will be of exceptional economic benefit to SA.
    • Provide detailed information on the economic impact of your proposed scheme on South Australia.
    • Agree with Skilled & Business Migration by registering your arrival in South Australia.
    • Maintain current contact information for the duration of your visa.

Queensland nomination:

  • You must be able to demonstrate a genuine commitment to Queensland.
  • Have a business and personal net worth of at least AUD$1.25 million to transfer to Queensland once the visa is granted.
  • After being granted a visa, you must invest in one or two eligible businesses:
  • Business investment of at least AUD $400,000 – Greater Brisbane and Gold Coast regions.
  • Business investment of at least AUD $300,000 – low-income areas of Queensland.
  • Real estate development business will not be accepted.
  • Export business must develop international markets for Queensland products.
  • General importing business will not be acceptable

Business visa 888 (Permanent):

  • For entrepreneurs, investors, and business owners to continue their activity in Australia.
  • You must hold a relevant stream of the subclass 188 visa.
  • You can apply for permanent visa 888 after 3 years while you still have the 188 temporary visa.
  • You must be able to show ongoing business involvement.
  • You must meet certain business requirements.
  • You have a current nomination from an Australian state or territory government agency.
  • You can stay in Australia permanently.
  • You (and your family) can work and study in Australia.
  • You are eligible fro Mediacre.

More eligibility requirements for visa 888:

  • Be in Australia for at least 12 months on a subclass 188 visa in the two years before applying for an 888 visa.
  • Have a business in Australia with an annual turnover of at least $300,000 for at least one year prior to applying for an 888 visa.
  • Have direct and continuous business management for at least 2 years before applying for the 888 visa.
  • In the 12 months before applying for the 888 visa, meet two of the following three conditions:
            – Employ at least two full-time Australian employees in your business in Australia
            – Personal and business net worth of at least $600,000
            – Having a business in Australia with an annual turnover of at least $300,000
