Partners in Australia

1. Partner visas options (in Australia):

Temporary Partner visa 820:

  • Temporarily visa until your permanent Partner visa (801) application is finalised.
  • Be married or in a de facto relationship
  • You should be sponsored by a de facto partner or spouse of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.
  • This leads directly to the permanent Partner visa
  • You must be in Australia when you apply

With this visa, you can:

  • Stay in Australia
  • Work in Australia
  • Study in Australia
  • Travel to and from Australia as many times as you want
  • Attend free English language classes provided by the Adult Migrant English Program.
  • Apply for Medicare.

Permanent Partner visa 801:

  • Be married or in a de facto relationship
  • You must hold a temporary Partner visa (820)
  • 2 years must have passed since you applied for the 820 visa to be assessed for the permanent visa.
  • Continue to meet relationship requirements
  • Live together, or not live permanently separate and apart

2. Partner visas options (outside Australia):

Temporary Partner visa 309:

  • Temporarily visa until your permanent Partner visa (100) application is finalised.
  • Be married or in a de facto relationship
  • You should be sponsored by a de facto partner or spouse of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.
  • This leads directly to the permanent Partner visa
  • You must be outside Australia when you apply

With this visa, you can:

  • Stay in Australia
  • Work in Australia
  • Study in Australia
  • Travel to and from Australia as many times as you want
  • Attend free English language classes provided by the Adult Migrant English Program.
  • Apply for Medicare.

Permanent Partner visa 100:

  • Be married or in a de facto relationship
  • You must hold a temporary Partner visa (309)
  • 2 years must have passed since you applied for the 309 visa to be assessed for the permanent visa.
  • Continue to meet relationship requirements
  • Live together, or not live permanently separate and apart

Prospective Marriage visa (300):

  • This visa lets you come to Australia to marry your prospective spouse and then apply for a Partner visa.
  • Be 18 years old or older
  • You should be sponsored by a de facto partner or spouse of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.
  • Intend to marry your prospective spouse before the visa period ends
  • Be outside of Australia when you apply for this visa.

With this visa, you can:

  • Stay in Australia for between 9 and 15 months from the visa grant date.
  • Work and study in Australia.
  • Travel to and from Australia as many times as you want while the visa is valid

Settle in Australia:

  • You should apply for a Partner visa (820 and 801) after you are married, and before your 300 visa ends.
  • You can get married in Australia or any other country.
  • Your marriage must be valid under Australian law.
